Terms & Conditions
1. Scope
These Terms and Conditions apply to the use of the app "Tippolo" (the "App") and all services and in-app purchases offered through it. The operator of the App is Simon Bogner, Feinerweg 11, 85540 Haar, Germany (the "Provider").
2. Description of Services & Participation
- The App offers a prediction game for sports events. Participation in the base game is free.
- Users may make voluntary payments ("Buy a coffee") or unlock paid additional features ("Premium") within the App.
- There is no entitlement to permanent availability of the App or the underlying server infrastructure (Supabase).
3. In-App Purchases & Contract Formation
- The display of in-app purchases in the App does not constitute a legally binding offer but an invitation to order.
- A contract for the purchase of digital content is formed when the user taps the purchase button and confirms via their App Store account (Apple ID).
- Billing and technical processing are handled exclusively through the Apple App Store. The terms of Apple Distribution International Ltd. apply in addition.
4. Prices & Payment
- The prices displayed in the App at the time of purchase apply. All prices are final.
- Under the small business exemption (e.g. § 19 UStG where applicable), no VAT is charged or shown.
5. Right of Withdrawal for Digital Content
- Withdrawal notice: You have the right to withdraw from this contract within fourteen days without giving a reason. The withdrawal period is fourteen days from the date of contract conclusion.
- Early expiry: The right of withdrawal expires early for contracts for the supply of digital content not supplied on a tangible medium if the user has expressly agreed that the Provider may begin performance before the end of the withdrawal period and has acknowledged that consent means loss of the right of withdrawal once performance has begun.
- To exercise your right of withdrawal, you must contact Apple App Store Support directly, as the Provider has no access to payment processing.
6. User Obligations & Conduct
- Users must not use unlawful, offensive or pornographic content when choosing group names or uploading profile pictures.
- The Provider reserves the right to delete content or user accounts for violations of these rules without prior notice.
7. Limitation of Liability
- The Provider is not liable for the accuracy of information provided in the App (e.g. match results, schedules).
- Liability for damage arising from use of the App is limited to intent and gross negligence. This does not apply to injury to life, body or health.
8. Final Provisions
- The law of the Federal Republic of Germany applies.
- If individual provisions of these Terms are invalid, the validity of the remaining provisions is unaffected.
